By accessing and using AI-Buddy ("Service"), a SaaS platform provided by TiBaTec GmbH ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Use ("Terms").

If you do not agree to these Terms, you may not use our Service. We reserve the right to modify these Terms at any time, and your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Service Description

AI-Buddy is an AI-powered communication platform that provides:

• Intelligent chat agents for website integration
• Real-time voice communication via webchat
• Direct telephony integration for inbound and outbound calls
• Knowledge source management and RAG (Retrieval Augmented Generation)
• Comprehensive analytics and reporting tools

3. User Accounts

To use our Service, you must create an account and provide accurate, complete, and current information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Payment

AI-Buddy offers various subscription tiers. You agree to pay the fees associated with your chosen subscription.

Billing is done monthly or annually in advance, depending on your selected plan. All fees are non-refundable unless otherwise required by law.

You may cancel your subscription at any time through your account dashboard. Cancellation will be effective at the end of your current billing period.

Refunds are provided only in accordance with our refund policy, which is made available separately.

5. Acceptable Use

You agree to use AI-Buddy for lawful purposes only. You may not:

• Use the Service for any illegal activities or to violate any laws
• Transmit any harmful, threatening, or defamatory content
• Send spam, unsolicited advertising, or intrusive messages
• Attempt to reverse engineer, decompile, or disassemble the Service
• Abuse or excessively burden the Service infrastructure

6. Intellectual Property

All rights, title, and interest in the Service, including all software, technology, and content, are and will remain the exclusive property of TiBaTec GmbH and its licensors.

We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain all rights to the content you upload to the Service. You grant us a worldwide license to use, store, and process your content solely for the purpose of providing the Service.

7. Data Protection and Privacy

We process personal data in accordance with GDPR (General Data Protection Regulation) and other applicable data protection laws. All data is processed and stored in Germany.

Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use, and protect your information.

8. Service Availability

We strive for 99.9% availability but do not guarantee that the Service will be uninterrupted or error-free at all times.

We reserve the right to interrupt the Service for maintenance and will notify you in advance whenever possible.

9. Limitation of Liability

The Service is provided "as is" and "as available" without any warranty of any kind, express or implied.

In no event shall TiBaTec GmbH be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Service.

10. Termination

You may terminate your account at any time by contacting us or using the account closure feature in your dashboard.

We reserve the right to terminate or suspend your access to the Service with or without cause, with or without notice.

Upon termination, your right to access the Service will cease immediately, and all your data will be deleted in accordance with our data retention policy.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through a notice on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Germany.
